David L. Johnson, deceased killer of famed goat author Alfred the Goat, is seeking an appeal on his conviction at the end of last week's trial.
Mr. Johnson's lawyer claims that District Attorney Harvey Dent planted a pine shard similar to the type used in Mr. Johnson's casket near the scene in order to sway the jury.
DA Dent has declined to comment. The appeal trial is set to start in mid-January.
